Terms of Service

Welcome to DreamLove.ai. These Terms of Service (“Terms”) constitute a legal agreement between you and DreamLove (“we”, “us”, or “our”). By accessing or using our website and services, you agree to be bound by these Terms. If you do not agree, please do not use our services.

1. Eligibility

You must be at least 18 years of age to use DreamLove.ai. By using our services, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these terms.

2. Account

• You are responsible for maintaining the security of your account credentials.
• You are responsible for all activities that occur under your account.
• You must provide accurate information when creating your account.

3. Credits and Payments

• Credits are purchased through our Stripe-powered checkout system.
• All credit purchases are final and non-refundable.
• Credits do not expire and remain in your account until used.
• Prices are listed in USD and may change at any time without prior notice.
• New accounts receive a limited number of free credits for trial purposes.

4. Acceptable Use

You agree NOT to use our services to:

• Generate content involving minors in any sexual or inappropriate context
• Upload or use images of any person without that person's explicit consent
• Create intimate or romantic content depicting real, identifiable individuals (including public figures and celebrities) without their verifiable consent
• Create non-consensual intimate imagery as defined by applicable law, including the TAKE IT DOWN Act (18 U.S.C. § 1802)
• Generate content that promotes violence, terrorism, or illegal activities
• Attempt to reverse-engineer, decompile, or hack our systems
• Resell or redistribute our services without authorization

5. Consent & Image Rights

By uploading photos to DreamLove.ai, you represent and warrant that you have obtained explicit consent from all individuals depicted in the photos for the creation of AI-generated content. You acknowledge that:

• You are solely responsible for obtaining and maintaining proof of consent from all depicted individuals.
• DreamLove.ai may, but is not obligated to, verify consent and bears no liability for content created without proper authorization.
• Uploading images of individuals without their consent may violate federal and state laws, including the TAKE IT DOWN Act, and may result in civil and criminal liability.
• Violations will result in immediate account termination without refund.

6. Content Removal (TAKE IT DOWN Act)

In compliance with the TAKE IT DOWN Act (18 U.S.C. § 1802), any individual who appears in content generated on our platform may request its removal:

• Submit a removal request to report@dreamlove.ai with a description of the content and your identity verification.
• We will remove the content within 48 hours of receiving a valid request.
• The account holder who created the content will be notified of the removal.
• Repeated violations will result in permanent account termination.

7. AI-Generated Content

• Content generated using our AI tools is provided “as is” without any guarantees of accuracy or quality.
• You are solely responsible for how you use, share, or distribute AI-generated content.
• We do not claim ownership of content you generate, but we reserve the right to remove content that violates these terms.
• AI-generated content may not be perfectly accurate and should not be relied upon for critical decisions.

8. Creative Content

DreamLove.ai provides AI tools that generate video content based on your inputs. By using these tools, you confirm that:

• You are at least 18 years old
• Creating AI-generated content is legal in your jurisdiction
• You will not share generated content with minors
• You accept full responsibility for the content you create and how it is used

9. Intellectual Property

The DreamLove.ai website, brand, and underlying technology are our intellectual property. You may not copy, modify, or distribute our platform or its components without permission.

10. Limitation of Liability

To the maximum extent permitted by law, DreamLove.ai shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Disclaimer

Our services are provided “as is” and “as available” without warranties of any kind, either express or implied. We do not guarantee that our services will be uninterrupted, error-free, or secure.

12. Termination

We reserve the right to suspend or terminate your account at any time if you violate these terms. Upon termination, your remaining credits will be forfeited.

13. Changes to Terms

We may modify these terms at any time. Continued use of our services after changes constitutes acceptance of the updated terms.

14. Dispute Resolution

Any dispute arising from or relating to these Terms or your use of our services shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Judgment on the award may be entered in any court of competent jurisdiction.

Class Action Waiver: You agree that any arbitration or court proceeding shall be conducted on an individual basis and not as a class action, collective action, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Small Claims Exception: Either party may bring an individual action in small claims court in lieu of arbitration.

15. Governing Law

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles.
